Last Updated: October 23, 2026 (draft)

LV Trail LLC ("Company," "we," "us," or "our") respects your privacy and is committed to protecting your personal information. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website playstillstanding.com (the "Site") or use our services, including the Still Standing sports pool platform (collectively, the "Services"). Still Standing is a service of LV Trail LLC. This Privacy Policy applies to the Site and the Services only. LV Trail LLC's separate website at lvtrail.com has its own privacy policy.

Please read this Privacy Policy carefully. By accessing or using the Site or Services, you acknowledge that you have read, understood, and agree to be bound by this Privacy Policy. If you do not agree with the terms of this Privacy Policy, please do not access the Site or use our Services.

1. Key Definitions

For purposes of this Privacy Policy, the following terms have the meanings set forth below:

Personal Information. Personal Information means any information that identifies, relates to, describes, or is capable of being associated with a particular individual, including but not limited to name, postal address, email address, telephone number, IP address, payment information, and any other identifier that permits physical or online contact with a specific individual.

Site. Site means the website located at playstillstanding.com and any associated subdomains, mobile applications, or online platforms operated by the Company in connection with Still Standing.

Services. Services means the sports pool platform provided by the Company through the Site, including tools to create and run a League, invite members, make picks, view standings and the Board, plan future picks, and receive League emails. Services include pro football playoff survivor and college playoff survivor pools today, and may include other pool formats and golf pools or trips in the future.

League. League means a pool created and run on the Site by a Commissioner, together with its members, entries, picks, and results.

Commissioner and Co-Commissioner. Commissioner means the person who creates and runs a League, including setting its rules, sending invitations, and deciding its results. Co-Commissioner means a person a Commissioner has given helper or staff access to a League.

Player. Player means a person who joins a League and makes picks.

Super-Admin. Super-Admin means the Company's own personnel who operate the Site.

You/Your. You or Your means the individual accessing the Site or using the Services, whether as a visitor, Commissioner, Co-Commissioner, Player, or other user.

2. Information We Collect

We collect several categories of information from and about users of our Site and Services, including Personal Information and non-personal information.

Information You Provide Directly

  • Contact Information. When you contact us, request information, ask to run a League, or request a custom pool, we may collect your name, email address, pool name, expected pool size, a description of what you want, and any other information you choose to provide.

  • Account Information. If you create an account or join a League, we collect your name, email address, and password. Passwords are stored only as hashes and are never stored in readable form. Commissioners starting a League, and Super-Admins, sign in with one-time sign-in codes or links sent by email. A "My leagues" page lists the Leagues associated with your email address.

  • Payment Information. We do not collect or store payment card information through the Site. If you purchase a paid plan for the Services (fees for use of the Still Standing software, which the Services may charge beginning with the 2027–28 season), payments will be processed by our third-party payment processor (Stripe) once paid plans begin, which collects your billing information directly and handles it in accordance with its own privacy policy. We do not store complete payment card information on our servers.

  • Billing Records. If you purchase a paid plan, we keep records of your purchases, including your name, email address, the League and plan purchased, amounts charged, dates, taxes, credits or promotions applied, refunds, and payment status. We do not store card details. We keep only the payment status our processor returns to us.

  • No Pool Money. The Site never collects, holds, or pays out pool money, meaning entry fees, prizes, or other money exchanged between a League's members. If a Commissioner collects or pays out pool money for a League, that happens entirely off the Site and between the Commissioner and the League's members. Any fees we charge are only for use of the Still Standing software.

  • League and Pool Activity. When you take part in a League, we collect your entry names, picks, tiebreaker guesses, planned future picks saved in the pick "Planner," acknowledgements of League rules, and insurance choices. If you are a Commissioner or Co-Commissioner, we also collect the League name, rules notes, announcements, invitations you send, and any results you enter or correct. If a Commissioner chooses to tell us, we also record where the League's group is based (a town or ZIP code) and what kind of group it is (for example, an office, friends, or a club). We use this only in aggregate, to understand where pools are played.

  • Email Preferences and Opt-Ins. We collect your email preferences, and whether you have opted in to an optional "Keep me posted" email list (currently switched off), to a "remind me before the playoffs" or "remind me in August" reminder, or to occasional news about Still Standing (an optional box that is never ticked for you).

  • Referral Information. If you arrive through a referral link, we record the referral code and which link referred you. We may also ask "How did you hear about us?"

  • Communications. We collect the content of communications you send to us, including emails and contact form submissions.

  • Feedback and Surveys. If you participate in surveys, or submit feedback, we collect the information you provide in those submissions. Feedback submitted through the Feedback button includes your name, email address, role, message, the page you were on, and whether we may contact you about it. Our end-of-season survey may ask about your experience and what you would be willing to pay in a future season. These are hypothetical price questions, not offers.

Information Collected Automatically

  • Device and Usage Information. When you access the Site, we automatically collect information about your device and usage, including IP address, browser type and version, operating system, device identifiers, referring/exit pages, pages viewed, time spent on pages, access times, and other diagnostic data. Inside Leagues and admin pages, we record sign-in records (IP address and browser user agent) for security. Google Analytics is used on our public pages and, with the League's name removed, on League pages (see Section 5).

  • Email and Visit Counts. For each League, we record how many emails of each kind are sent and when (not their content), so we can keep sending within safe limits and stop misuse. We also record which signed-in members visited a League on a given day (not which pages they viewed), so we can show how many people use each League each week. We report these only as totals.

  • Cookies and Tracking Technologies. We use cookies and similar technologies, including browser storage, to collect information about your browsing activities and preferences. For more information about cookies and how to manage them, please see the Cookies and Tracking Technologies section below or adjust your browser settings.

  • Analytics Data. We use analytics services (such as Google Analytics) to collect aggregated usage statistics and analyze trends in Site usage on our public pages and on League pages, including the Commissioner's admin pages, with the League's name removed. On League pages, the page address sent to Google Analytics has the League's name removed and the page title replaced, and no names, email addresses, picks or account identifiers are sent.

  • Location Data. We may collect general geographic location information based on your IP address or device settings, through Google Analytics on our public pages and on League pages, including the Commissioner's admin pages, with the League's name removed.

Information from Third Parties

  • Service Providers. We may receive information about you from third-party service providers who assist us in operating the Site, conducting our business, or providing Services, such as hosting providers, payment processors, database providers, and email delivery providers. For example, our payment processor tells us whether a payment succeeded, failed, was refunded, or was disputed.

  • Commissioners. When a Commissioner or Co-Commissioner invites you to a League, they give us your name and email address so the Site can send you the invitation. They may also enter or correct information about your entries and picks under their League's rules.

3. How We Use Your Information

We use the information we collect for the following purposes:

Providing and Managing Services

  • To deliver, maintain, and improve our Services, including creating and running Leagues, recording and scoring picks, showing standings and the Board, and the pick Planner.

  • To process transactions, send receipts and invoices, collect payments, and manage customer accounts, including renewals, failed payments, refunds, disputes, and any credits or promotions applied. Survivor Leagues are free for the 2026–27 season (through February 2027). Fees, if any, apply only to purchases you agree to, such as Leagues in later seasons or other kinds of pools.

  • To manage accounts and sign-in, including sending one-time sign-in codes and links.

  • To communicate with you about your Leagues, picks, account status, and technical support issues, including League invitations sent by your Commissioner through the Site, pick reminders, round recaps, and release notes to Commissioners.

  • To help Commissioners set up Leagues, and to respond to requests for custom pools.

  • To draft a recap after each round for the Commissioner, using an artificial intelligence service (see Section 4). The Commissioner reviews and edits the recap before sending it.

  • To show Players, in the Planner, the share of picks on each team across other Leagues, as counts only (see Section 4).

  • To record which referral link brought you to the Site, and how you heard about us, and, if we offer referral credits in the future, to apply them.

  • To comply with tax, accounting, and recordkeeping obligations for paid plans.

Marketing and Communications

  • To send you release notes, emails to our optional "Keep me posted" list (currently switched off), and "remind me in August" reminders you have asked for, subject to your consent where required by law.

  • To respond to your inquiries, comments, and requests for information.

  • To conduct market research, surveys, and customer satisfaction assessments, including our end-of-season survey and one reminder about it, which we will use in setting any pricing for future seasons.

Site Operation and Improvement

  • To operate, maintain, and improve the functionality, performance, and security of the Site.

  • To analyze usage patterns, trends, and user preferences to enhance user experience.

  • To troubleshoot technical issues and perform system diagnostics.

Legal Compliance and Protection

  • To comply with applicable laws, regulations, legal processes, and governmental requests.

  • To enforce our Terms of Use, contracts, and other legal agreements.

  • To protect the rights, property, safety, and security of the Company, our users and the public.

  • To detect, prevent, and respond to fraud, security incidents, unauthorized access, and other illegal activities.

Business Operations

  • To manage our internal business operations, including accounting, auditing, and financial reporting.

  • To conduct due diligence in connection with business transactions, such as mergers, acquisitions, or asset sales.

  • To establish, exercise, or defend legal claims.

Other Purposes. For any other purpose disclosed to you at the time we collect your information or with your consent.

4. How We Share Your Information

We may share your Personal Information with third parties under the following circumstances:

Service Providers and Vendors

  • We share information with third-party service providers who perform services on our behalf, including web hosting, cloud storage, payment processing, email delivery, analytics, artificial intelligence, customer support, IT maintenance, and professional services (such as legal and accounting).

  • Our current service providers are: Vercel (hosting); Neon (databases, with a separate database for each League); Resend (email delivery); Anthropic (artificial intelligence used to draft round recaps and to answer Commissioners' questions on the Commish Board); and Google Analytics (analytics on our public pages and on League pages, including the Commissioner's admin pages, with the League's name removed). When paid plans begin, Stripe will process payments.

  • Round Recaps. To draft a round recap, we send Anthropic that round's pool facts: how many entries picked each team, the entry names of entries eliminated, and the League name. The service researches the real games on the web and returns a draft, which the Commissioner edits and sends to the League. When a Commissioner uses the Commish Board assistant, we send Anthropic the League's settings and the Commissioner's question, never Player names, emails or picks.

  • Sports Data Providers. We get scores, schedules, and odds from sports data providers (currently ESPN, CollegeFootballData, Highlightly, and The Odds API). We do not send them any Personal Information.

  • These service providers are contractually obligated to use your information only for the purposes of providing services to us and to maintain appropriate security measures.

Within Your League

  • The Commissioner and Co-Commissioners of a League you join can see members' names, email addresses, entries, and picks for that League.

  • Other Players in your League can see your name and entry names, and your picks are shown to them on "the Board" only after each round locks. Round recaps sent by your Commissioner may mention entry names, including those eliminated.

  • If Players pay fees for a League, the League's Commissioner and Co-Commissioners may see whether each member's fees have been paid, but not the amounts.

Our Staff

  • Our Super-Admins can view any League's information, including members' names, email addresses, entries, and picks, to operate the Site, help Commissioners and Players, fix problems, and enforce our Terms of Use. They view a League without changing it unless a change is needed to provide support or fix a problem. Every Super-Admin visit to a League, and any change made, is recorded in that League's change log, which the League's Commissioner can see.

Business Transfers. In connection with any merger, sale of company assets, financing, acquisition, divestiture, dissolution, bankruptcy, or other business transaction or negotiation, your information may be transferred to a successor or affiliate entity, subject to this Privacy Policy or a successor privacy policy.

Legal Obligations and Protection

  • We may disclose your information to government authorities, law enforcement, regulatory agencies, courts, or other third parties when we believe disclosure is necessary or appropriate to comply with applicable law, regulation, legal process, or enforceable governmental request.

  • We may disclose information to protect the rights, property, safety, or security of the Company, our users or others, including enforcing our agreements and policies and preventing fraud or illegal activity.

With Your Consent. We may share your information with third parties when you have provided your express consent to such sharing.

Aggregated or De-Identified Information. We may share aggregated, anonymized, or de-identified information that does not identify you personally for research, marketing, analytics, or other business purposes. For example, the Planner shows Players the share of picks on each team across other Leagues. This shows counts only and never names. It appears only when there are at least 100 picks from at least 5 other pools and no single pool makes up more than 40% of them, and it never includes the Player's own pool.

No Sale of Personal Information. We do not sell your Personal Information, and we do not share your Personal Information with third-party advertising platforms for targeted advertising.

5. Cookies and Tracking Technologies

Use of Cookies

  • We use cookies and similar technologies (such as browser storage) to collect information about your browsing behavior, preferences, and interactions with the Site.

  • Cookies are small data files stored on your device that help us recognize you, remember your preferences, and analyze Site usage.

Types of Cookies

  • Essential Cookies. These cookies are necessary for the Site to function properly and cannot be disabled in our systems. They enable core functionality such as security, network management, and accessibility. They include hub_session (keeps you signed in to a League), hub_me (keeps you signed in to your "My leagues" page), and hub_admin (Super-Admin sign-in).

  • Analytics Cookies. These cookies collect information about how you use the Site, such as pages visited and links clicked. We use this information to improve Site performance and user experience. We use Google Analytics for this purpose on our public pages and on the League pages Players use. On League pages, the League's name is removed from what Google Analytics receives, and no names, email addresses, picks or account identifiers are sent. Google Analytics is never loaded on admin pages, password-reset or email-preference pages, and it is not loaded at all when your browser sends a Global Privacy Control or Do Not Track signal.

  • Functional Cookies. These cookies enable enhanced functionality and personalization, such as remembering your preferences and settings. We also use browser storage for small preferences, such as the preset you chose while setting up a League.

  • Referral Cookies. hr_ref and hr_ref_via record which referral link brought you to the Site. They last 90 days, and if you follow more than one referral link, the most recent one counts.

  • Advertising Cookies. We do not use advertising cookies, and we do not work with third-party advertising networks to serve targeted advertisements based on your browsing activity.

Managing Cookies

  • You can control and manage cookies through your browser settings. Most browsers allow you to refuse cookies or alert you when cookies are being sent. Please note that disabling cookies may affect the functionality of the Site and your ability to use certain features. Blocking essential cookies will prevent you from signing in.

  • To opt out of analytics tracking, you may use the Google Analytics Opt-out Browser Add-on, turn on Global Privacy Control or Do Not Track in your browser, or adjust your browser's cookie settings.

  • All of our cookie disclosures are contained in this Privacy Policy; we do not maintain a separate Cookie Policy.

6. Data Retention

Retention Period

  • We retain your Personal Information for as long as necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law.

  • The retention period depends on the nature of the information, the purposes for which it is processed, and applicable legal or regulatory requirements.

Criteria for Retention

  • We retain League information (members, entries, picks, and results) from season to season, so a Commissioner can run the League again the next season, until the Commissioner deletes the League or you ask us to delete your information.

  • We retain feedback and survey answers for three (3) years after they are submitted.

  • We retain sign-in records (IP address and browser user agent) for one (1) year.

  • We retain email counts and League visit records for two (2) years, and Super-Admin visit records for as long as the League's change log is kept.

  • We retain requests to run a League and custom pool requests, and related communications, for three (3) years after our last contact with you.

  • We retain your email preferences and opt-ins for as long as you have an account or remain on the list, and we keep a record of unsubscribes so we do not email you again.

  • We retain billing records for seven (7) years after the transaction for tax and accounting purposes, even if the League or your account is deleted.

  • We retain information as necessary to comply with our legal obligations, resolve disputes, enforce our agreements, and maintain business records.

Deletion

  • When Personal Information is no longer needed, we will securely delete or anonymize it in accordance with our data retention and deletion policies.

  • You may request deletion of your Personal Information by contacting us as set forth in Article 11, subject to legal, contractual, or operational limitations. A Commissioner may also delete a League, which deletes that League's information. If you have made picks in a League and ask to be deleted, we delete your name and email address and keep your picks under a neutral label (such as "Former member") so the League's standings and history stay accurate.

7. Data Security

Security Measures

  • We implement reasonable administrative, technical, and physical security measures designed to protect your Personal Information from unauthorized access, use, disclosure, alteration, and destruction.

  • These measures include encryption (including HTTPS encryption for information transmitted through the Site), access controls, and secure server infrastructure. Passwords are stored only as hashes, Commissioner and Super-Admin sign-in uses one-time codes or links sent by email, and each League's information is kept in its own separate database.

Limitations

  • No method of transmission over the Internet or electronic storage is completely secure. While we strive to protect your Personal Information, we cannot guarantee absolute security.

  • You are responsible for maintaining the confidentiality of any passwords or account credentials and for notifying us immediately of any unauthorized use of your account.

Data Breach Notification. In the event of a data breach that compromises your Personal Information, we will notify you and any applicable regulatory authorities in accordance with applicable law and within the timeframes required by law.

8. Your Privacy Rights

Depending on your location and applicable law, you may have certain rights regarding your Personal Information.

Access and Portability. You have the right to request access to the Personal Information we hold about you and to receive a copy of that information in a structured, commonly used, and machine-readable format.

Correction. You have the right to request that we correct any inaccurate or incomplete Personal Information we hold about you.

Deletion. You have the right to request that we delete your Personal Information, subject to certain exceptions (such as where we are required to retain information for legal or contractual reasons).

Opt-Out of Marketing. You have the right to opt out of receiving marketing communications from us at any time by following the unsubscribe instructions in our emails or by contacting us as set forth in Article 11. Even if you opt out of marketing communications, we may still send you transactional or administrative messages related to your account or the Services, such as receipts, renewal and price-change notices, and failed-payment notices. You can manage pick reminders and other League emails in your email preferences.

Do Not Track and Global Privacy Control. Some browsers include a "Do Not Track" feature, and some browsers or extensions support the Global Privacy Control (GPC). Because we do not sell Personal Information or use it for targeted advertising, these signals have limited application to our practices. When your browser sends either signal, our Site does not load Google Analytics.

If you are a resident of New Jersey, the New Jersey Data Privacy Act provides you with additional rights, including the right to confirm whether we process your Personal Information and to access it; the right to correct inaccuracies; the right to delete Personal Information; the right to obtain a portable copy of your Personal Information; and the right to opt out of the processing of your Personal Information for purposes of targeted advertising, the sale of Personal Information, or profiling in furtherance of decisions that produce legal or similarly significant effects. Your interactions with these third-party services are governed by the privacy policies of those third parties.
